How and what data do we collect?

Our website, like many others, uses cookies.  Cookies are small data files that get stored on your computer, if you have allowed your browser to capture them.  We use our cookies to remember who you are, along with what you last looked at on our site.

Anonymous Information. How does it work?

Gym & Fitness may share generic aggregated demographic information not linked to any personal identified information regarding visitors and users of the website for the purposes outlined above.

Non-personal identification information may include the browser name, device name, type of computer and technical information about users, means of connection to the website, such as the OS and/or the ISP utilized by the user or other similar non-personal technical information. When Gym & Fitness shares such information, it shares it so that the information remains anonymous at all times and cannot be reverted to be understood and processed as uniquely personal data.

What does Gym & Fitness collect Your Data for?

Gym & Fitness will only collect enough information to fulfil your purchase of gym and fitness equipment from our website.

This includes your name, email address and phone number so that we can communicate with you.  We also store this data to maintain your warranty details. We need to record your address, which is used for your delivery. Your name, address, email and phone number is shared with our carrier who needs that information to contact you and deliver your new equipment to you in an effortless manner.

We review the GDPR policies of all our suppliers, including our carriers, to ensure that they are aware of their obligations under the GDPR legislation and that they have a written policy compliant with those regulations. In addition to using your information to communicate with you and deliver your order, we may from time to time, and with your consent, utilise your contact information to inform you of specials and offers that may be of interest to you. You must tell us if you do not want us to either contact you or delete all of your details and information from our system. We will gladly do so when requested.

We do not store bank account or credit card details. A GDPR compliant payment processor handles these on our behalf. We never see your credit card details and therefore cannot store them.

  • Online retail partners in order to fulfil customer purchases where delivery is arranged directly from the retail partner.
  • Visitors to the website: When someone visits www.gymandfitnessequipment.co.uk we use a third party service, Google Analytics, to collect standard internet log information and details of visitors behaviour patterns. We do this to find out visitor behavioural patterns on the website in order to improve the experience for the customer. This process does not identify individuals and we do not make any attempt to identify our visitors, nor does Google.
  • Search queries and results are logged anonymously to help us improve our website and search functionality. Neither Gym and Fitness nor any third party collects user-specific data.
  • If we do collect personally identifiable information via our website, we will be up front about this and make it clear that we are collecting it and explain what we will be doing with it.

How long does Gym & Fitness hold your information for?

Due to the nature of our business where we provide customers with gym and fitness equipment which has on average a 5-year warranty and owing to understanding our customer life cycle, we will retain customer information for 5 years.

HMRC rules and regulations dictate that we are obliged to retain customer records for 6 years.

To whom may Gym & Fitness disclose your data?

Gym & Fitness does not sell, trade, or rent your data and therefore exchange or sharing of data with third parties is strictly limited and, only made in accordance to the applicable laws subject to the following:

  • Gym & Fitness may share administrator data for purposes of website security and/or fraud prevention.
  • Gym & Fitness may use third party service providers to help in the operation of Gym & Fitness business, the operation of the website and/or to administer activities on Gym & Fitness' behalf. You are entitled to access, rectify or request deletion of Your Data at any time and to such effect you should contact the Data Processor to the contacts and address identified in the content above.

Gym & Fitness will reasonably assist you on the exercise of your rights.

What Laws and Jurisdiction?

Your Data will be collected, stored, processed, and managed by Data Processor according to this Policy and the UK laws on Data Privacy as amended and in force from time to time to the extent applicable to Your Data. No further laws shall apply to your information and/or data.

Any disputes on Data Privacy or Your Information shall be resolved by the Civil Courts of London, United Kingdom.

Execution processing

  1. Gym & Fitness will handle the personal data in a careful manner and only process the personal data in accordance with this agreement and the regulations in the relevant legislation, insofar as these regulations are directed directly at Processors.
  2. Gym & Fitness will not process the personal data for any other purpose or in any other way than according to your instructions, including the instructions set out in this agreement. Gym & Fitness also has no control over the purpose and means for the processing of personal data. The instructions of the user may not be in conflict with the relevant legislation.
  3. Gym & Fitness further warrant that persons who act under its authority will only process the personal data in a lawful manner and in accordance with this agreement and the relevant UK legislation, wherever in the world they may be located.
  4. Gym & Fitness' obligations arising from this agreement also apply to those who process personal data under Gym & Fitness' authority, including but not limited to employees.

Transfer of personal data

  1. Gym & Fitness processes the personal data inside and outside the UK. Gym & Fitness will only process the personal data outside of the UK on the basis of this agreement.
  2. Gym & Fitness do work with third parties outside of the UK, and where this is the case, they are compliant with GDPR equivalent standards within their country of business.

Security measures and incidents

  1. Gym & Fitness takes all appropriate technical and organizational measures to protect  data against loss or any form of unlawful processing. These measures are an appropriate level of security of the personal data being processed.
  2. Gym & Fitness takes at least the following measures to this end:
    1. Security of network connections via Secure Socket Layer (SSL) technology;
    2. Encryption of users passwords;
    3. Limitation of access to data by Gym & Fitness Equipment Suppliers Ltd Employees;
  3. Gym & Fitness will report theft, loss, or misuse of personal data to the user as soon as practicable. Where necessary, Gym & Fitness will fully cooperate to adequately inform the ICO and relevant persons about such security incidents or data leaks.

Duration and termination

  1. This Agreement between Gym & Fitness and the User continues so long as the User has an account on which personal data has been entered by the User either online or manually and maintains a relationship with Gym & Fitness.
  2. If this Agreement ends or is terminated, Gym & Fitness and the User must continue to comply with the provisions of this Agreement with respect to confidentiality, liability, indemnification and all other provisions that by their nature are intended to continue even after termination of this Agreement.
  3. If this Agreement ends or is dissolved, Gym & Fitness will give the User the opportunity during 10 weeks to transfer all data, including personal data, that is present at Gym & Fitness on the basis of this Agreement to another location. After this period, Gym & Fitness will remove or destroy all data, including personal data, that are present with it pursuant to this Agreement (including any copies thereof).

Confidentiality of processed data

  1. All personal data that Gym & Fitness processes for the User is subject to a confidentiality obligation towards third parties. All persons employed by or working for Gym & Fitness, as well as Gym & Fitness itself, are obliged to maintain confidentiality of the personal data.
  2. Gym & Fitness will not provide, copy, reproduce or make public  personal data to third parties without permission from the User.

Assistance

  1. Gym & Fitness will, wherever possible, assist the User to respond to requests from Data subjects regarding the exercise of their rights. This may for example concern the data subject's request for access, rectification, erasure, or restriction of the processing of personal data and the right to data portability. Gym & Fitness takes appropriate technical and organizational measures to this end.
  2. Gym & Fitness will, if requested by the User, provide all necessary information that the User needs for the performance of audits, inspections, and data protection impact assessments.
  3. The User will assume all costs related to the exercise of the rights and obligations from the previous provisions.

Sub processors

  1. Gym & Fitness uses some external services when providing the Services. Because these services process some of the personal data that Gym & Fitness hold, they act as a sub processor within the context of the relevant legislation related to Sub Processors.
  2. Gym & Fitness will only contract other Sub Processors if this is necessary to perform specific processing activities for the benefit of the Services.
  3. All Sub Processors will be bound by the same terms and conditions as those contained in this Agreement where possible.

Liability

Gym & Fitness is not liable for damage caused by following the instructions of the User, if these instructions are in conflict with the Relevant Legislation.

Guarantee Responsible

  1. The User guarantees that the processing of the personal data of the Data Subject, as referred to in this Agreement, is not unlawful and that no violation is made of the rights of others.
  2. The User indemnifies Gym & Fitness Equipment Suppliers Ltd against all claims relating to the legality of the processing of personal data.
